Q: Elaborate the proceedings of final argument of court ?
Ans: When the process of evidence and cross examination are completed on behalf of both the parties, the case comes to the final argument. At this stage, the advocates from both sides argue in support of their respective cases and point out each other's shortcomings before the court. After the completion of this phase, the trial comes to the stage of adjudication.
At this stage of decision, only and only the Court has the right to take all the proceedings. While deciding, the court considers the whole case from beginning to end to get in a position of giving judgment.
If the decision is passed in favour of the complainant, the accused may be punished with an imprisonment upto 2 years or fine which may be upto two times the amount of cheque or both.
Note: It is a compoundable offence and the parties can withdraw the case by mutual consent at any time before the court gives a judgment.
